1.General Provisions:
This User Agreement ("Agreement") becomes effective as of March 1, 2024. It outlines the terms that govern your use of the services accessible at www.korimt.com ("Service"). If you do not agree to these terms, please refrain from using the Service. By utilizing the Service, you consent to all the terms laid out in this User Agreement.
Throughout this Agreement, the terms "Kori Money Transfer," "we," "us," and "our" refer to Kori Global Services Inc., a Canadian Federal Corporation, including its employees, directors, successors, and assignees. "You" and "your" pertain to users of the Service, whether acting as Senders or Recipients.
The terms "you" and "your" also encompass users of the Service, including Senders, Recipients, other users, or visitors to the website.
These Terms and Conditions become effective from the moment you first access, register, or use the Service. They are subject to change periodically.
The Service was developed to aid customers in sending and receiving money from family and friends worldwide.
2.Definitions:
In these Terms and Conditions:
"App" refers to Kori Money Transfer's mobile application for sending Payment Requests and/or Transaction Requests, where available.
"Business Day" denotes any day on which we are open for executing Transaction Requests and/or Payment Requests.
"Destination Country" signifies the country where the Payee receives money through the Service.
"Instruction" represents a Payment Request and/or a Transaction Request.
"Payment Instrument" denotes a valid payment method such as a bank account, debit card, or credit card.
"Payment Request" refers to a specific instruction from you to a Sender requesting a Transaction.
"Prohibited" encompasses activities involving narcotics, steroids, pharmaceuticals, chemicals, drug paraphernalia, tobacco, seeds, plants, animals, military or semi-military goods or services, weapons (including dual-use goods), adult services or content, bitcoin or other cryptocurrency, binary options, gambling services, or any other activities prohibited by Kori Money Transfer's policies, as amended from time to time.
"Recipient" signifies a Payee to whom the funds are being sent.
"Remittance" denotes the money transfer to the intended beneficiary by the sender.
"Sender" refers to someone who uses the Service to send money.
Services" refers to money transfer.
"Service Fee" encompasses Kori Money Transfer's fee along with any supplementary charges or local taxes relevant to each transaction, which Kori Money Transfer may levy at its discretion in compliance with applicable laws, as outlined in these Terms and Conditions and on the Kori Money Transfer website periodically.
"Service Provider" denotes a local bank, money exchange house, or other third-party service providers (such as Payment Aggregators) in the destination country collaborating with Kori Money Transfer to deliver the service.
"Transaction" denotes the transfer of money or remittance.
"Transaction Amount" signifies the sum of money excluding any applicable Service Fee and before any foreign exchange conversion.
"Transaction History" refers to the log of your transactions on our website, accessible using your email and password registration details.
"Transaction Request" indicates a specific instruction from you, soliciting us to dispatch money or AirTime Top Up to a payee through the service.
"Website" denotes Kori Money Transfer's web portal for sending Payment Requests and/or Transaction Requests, where available.
"Kori Money Transfer Wallet" signifies a function in the app or website storing E-money in a non-interest-bearing virtual account maintained by us for a Wallet holder, offering features we may periodically introduce. These features may encompass viewing the balance of funds in the Kori Money Transfer Wallet, loading additional funds into it, and issuing instructions for E-money to be disbursed from the Wallet for transactions or cashing it out to the sender's bank account. The funds cannot be transferred to any other Kori Money Transfer wallet holder or any other bank account except that of the account holder/Wallet holder.
3.Kori Money Transfer Obligations:
a. Under these Terms and Conditions, we commit to delivering the Service to you with reasonable care. You acknowledge that the service may not be fully available in certain regions, countries, or jurisdictions.
b. In accordance with this Agreement, Kori Money Transfer will consider each Transaction request as the customer’s instruction to make a payment to a designated beneficiary, either directly or through correspondent banks or other appropriate channels, as specified in the request. Kori Money Transfer reserves the right to request further instructions from the customer via the provided phone number or email address at the time of signup. Failure to comply with such requests may result in Kori Money Transfer refusing to process the Transaction request. Kori Money Transfer shall not be liable to the customer or any other party for failing to verify Payment requests.
c. Kori Money Transfer reserves the right to modify or terminate the Service or any part of it without prior notice, at any time.
d. We may, at our discretion, refuse any Transaction Request or set limits on the Transaction Amount. This refusal or limitation may apply to individual transactions or aggregate transactions, and may involve specific registration details or Payment Instruments. We also reserve the right to change the Payment Instruments we accept, at our sole discretion, at any time.
e. The delivery times quoted by Kori Money Transfer for processing remittance orders are indicative of the "normal" or average service and do not guarantee individual Service or Transaction times. The delivery time begins only after receiving a complete and accurate Transaction request along with all necessary funds, including fees and charges, from the customer. This duration is subject to change based on factors such as compliance holds or service availability.
f. While we endeavor to process transactions promptly, delays or cancellations may occur for various reasons, including but not limited to: identity verification efforts, validation of transaction instructions, attempts to contact you, variations in business hours and currency availability, or compliance with applicable laws.
g. We may communicate transaction-related notifications via email, SMS, or through the notification section of your profile on the Kori Money Transfer website or app. After receiving a transaction request, we will provide you with information enabling you to identify the transaction, including details such as the transaction amount, service fee, exchange rate, and the date of receipt of the transaction request.
h. We aim to provide Senders and Recipients with up-to-date information regarding the location and opening hours of our Service Providers through our website. However, you acknowledge that Kori Money Transfer shall not be held responsible for any inaccuracies in this information or any resulting loss due to incorrect or incomplete information.
4.Your Obligations:
4.1. You agree that:
4.1.1. You will not access, use, or attempt to use the Service to provide any Instructions unless you are at least 18 years old and have the legal capacity to form a binding legal contract in any relevant jurisdiction.
4.1.2. For each Transaction request you submit, you will pay us the stated Service Fee in addition to the Transaction Amount. Payment becomes due at the time you submit your Transaction Request. The Service Fee is generally non-refundable unless expressly stated in these Terms and Conditions. If a Transaction Request you submit results in Kori Money Transfer becoming liable for charges, including chargeback or other fees, you agree to reimburse us for all such fees.
4.1.3. We may apply a convenience/miscellaneous fee for processing credit cards/debit cards/Interac e-transfers at our discretion. If we charge such a fee, it will be disclosed to you before you submit the applicable Transaction Request.
4.1.4. In connection with your registration and use of the Service, you will:
a. Provide us with true, accurate, current, and complete evidence of your identity, and promptly update your personal information if it changes;
b. Provide us with any identity documentation as may be requested;
c. Provide us with details of one or more Payment Instruments;
d. Provide us with true, accurate, current, and complete information as indicated on the website to receive the Service and any other required information relating to the Recipient;
e. Provide us with:
i. Any other information necessary for a Transaction Request to be properly executed, as specified when you enter the details of the Transaction on our website; and
ii. Any information relating to the Transaction required to process the request.
4.2. We do not accept any liability for loss or damages resulting from non-payment or delay in payment of a Payout Amount to a Payee or failure to perform any Instruction under the Service if you are in breach of your obligations listed in this clause.
4.3. When using the Service under these Terms and Conditions, you are responsible for ensuring all details are accurate before submission. Once a Transaction Request is received, it is not normally possible to change any details. You will be given the opportunity to confirm Transaction Requests before submission, and you must check the details carefully.
4.4. The total amount (Transaction Amount, Service Fee, and other applicable fees and charges) you are required to pay, and the relevant exchange rate will be displayed clearly before you are asked to confirm your Transaction. Proceeding with the Transaction at this point is entirely optional.
4.5 When you initiate a payment with a Transaction Amount in one currency and the Payout Amount is in another currency, there will be a variance between the exchange rates utilized by us for purchasing foreign currency and those provided to you. Kori Money Transfer and its Service Providers typically generate a slight profit in such scenarios. We assure you of the Payout Amount in the local currency. The margin applied on foreign currency exchange accounts for our risk in ensuring this assurance. If the Payee's account is in a currency different from the one specified for the payment, there might be delays, extra charges, or varying exchange rates. Hence, it's the Sender's responsibility to ensure that the Transaction currency aligns with the account currency where the funds are to be received.
4.6 Kori Money Transfer bears no responsibility for any fees or charges incurred by you through the use of a specific Payment Instrument to fund a Transaction. These charges might include "cash advance" fees and additional interest imposed by credit card providers if they classify the Service usage as a cash transaction rather than a purchase. It's your responsibility to consult your financial institution regarding such fees.
4.7 You agree to only utilize the Service for sending Transaction Amounts to individuals whom you personally know, refraining from using it for paying third-party goods or services from unknown sources. Kori Money Transfer reserves the right to decline processing your Transaction Request if we suspect its use for purchasing goods or services from untrusted parties or for engaging in fraudulent, illegal, or Prohibited activities. If you opt to pay third parties for goods and services using the Service, you acknowledge that Kori Money Transfer holds no control over the quality, safety, legality, or delivery of such goods or services, and hence, any such use is at your own risk.
4.8 Both you and the Recipient must act solely on your own behalf. You cannot submit an Instruction or receive a Transaction on behalf of a third party.
4.9 By using the Service, you agree to comply with these Terms and Conditions along with any applicable laws, rules, or regulations. It's considered a breach of these Terms and Conditions to use the Service for sending Transaction Amounts to a Payee who has violated the terms or in connection with illegal activities such as money laundering, fraud, or funding terrorist organizations. Kori Money Transfer reserves the right to report any such illegal activities to the appropriate legal authorities.
4.10 When using our website or the Service, or when interacting with Kori Money Transfer, another user, or a third party, you agree not to:
4.10.1 Violate these Terms and Conditions or any other agreement with Kori Money Transfer.
4.10.2 Create more than one registration without prior written permission.
4.10.3 Provide false, inaccurate, or misleading information.
4.10.4 Allow anyone else access to your registration details, ensuring their safety and security.
4.10.5 Refuse to provide confirmation of any information provided to us or cooperate in any investigation.
4.10.6 Use anonymizing proxies or devices to conceal activity.
4.10.7 Copy or monitor our website or Services using any automated or manual process without prior written permission.
4.11 You acknowledge that nothing in these Terms and Conditions or any information provided by Kori Money Transfer constitutes legal or other advice. If necessary, you agree to seek advice from your own professional advisers regarding the application of Canadian or foreign laws to the Service.
5. Identification And Other Documents:
Under Canadian federal and provincial law, financial institutions are mandated to aid in combatting money laundering and terrorism financing by obtaining, verifying, and documenting identifying information about all customers. Consequently, we may request personal identifying information from you and the recipient, and we reserve the right to legally consult other sources to acquire relevant data.
Kori Money Transfer may also ask customers to provide documents concerning the source of funds and any other necessary documentation for remittance processing. Failure to comply with these requests may result in Kori Money Transfer refusing to accept instructions or process the remittance/payment service request.
If the information provided for your account is deemed unsatisfactory and does not meet our risk assessment criteria, we will deny our service, and your funds will be refunded via the original payment method.
We may disclose information about you and your financial transactions to government authorities and law enforcement agencies. Furthermore, we retain the right to report any suspicious financial transactions to relevant government authorities, including law enforcement agencies.
By using the Site or Services, you agree that Kori Money Transfer reserves the right, at its sole discretion, to terminate your account or use of the Site or Services, and to remove and discard any content within the Site, at any time and for any reason. You acknowledge that any actions taken under this section may occur without prior notice to you.
6. Fees And Other Charges:
Fees and additional charges levied by Kori Money Transfer will be determined at the time of transaction creation or finalization. Kori Money Transfer reserves the right to alter its fees and additional charges periodically without prior notice to the customer.
7. Payments To the Recipient:
The customer acknowledges that payments are executed solely based on the beneficiary's name and account number or wallet number provided by the customer. Even if these details designate a different individual or institution, payments will proceed. Any discrepancies in beneficiary information may lead to funds being returned, misrouted, lost, or delayed. Kori Money Transfer disclaims liability for any losses or damages arising from such errors or inconsistencies.
Kori Money Transfer does not guarantee the timing of crediting the beneficiary's account. Delays or unavailability of services may occur due to various factors including the amount sent, destination country, involvement of intermediary banks, regulatory requirements, time zone differences, bank operating hours/holidays, etc. Kori Money Transfer shall not be held liable for such conditions, sanctions, penalties, delays, or nonpayment.
At its discretion, Kori Money Transfer may furnish the customer with passwords or other authentication information for each payment request. It is the customer's responsibility to ensure the confidentiality and security of such information to prevent unauthorized access or use.
When you submit a Payment Request, you are asking us to process it on your behalf and agreeing to our contacting the Sender for this purpose. The customer must promptly inform Kori Money Transfer if their information has been compromised or accessed or used by an unauthorized person. While Kori Money Transfer may take reasonable measures to change authentication information or block Service access without prior notice, it is not obliged to do so. Kori Money Transfer is not liable for any losses or damages resulting from unauthorized access or use of authentication information. The customer must cooperate with Kori Money Transfer and authorities in investigating unauthorized access or use of authentication information.
Cancellation of Payment Requests: Once a Payment Request is submitted, it cannot be cancelled. In such cases, you must separately contact the Sender and explain that you want the Payment Request cancelled. Ensure that your Payment Requests are legitimate, accurate, and complete.
Cancellation of Transactions: Transaction cancellations are governed by these Terms and Conditions. You must cooperate with us regarding cancellation requests received from Senders after a Transaction has been initiated following your Payment Request. Upon our request, you must promptly refund to us or a third party (including the Sender) all funds received from Transactions believed to contravene these Terms and Conditions.
8. Refusals, Suspensions, Cancellations, Refunds, and Terminations
8.1 PAY'S RIGHT TO REFUSE, SUSPEND, OR CANCEL
We reserve the right to refuse any Transaction Request, Payment Request, or Transaction at any time and for any reason, or cancel it where applicable. Despite this, we outline below some situations in which such actions may occur.
8.1.1 We may, at our sole discretion, refuse or cancel Transaction Requests, Payment Requests, or Transactions if we suspect that the Service is being used, whether by you or the sending/receiving party, to facilitate illegal, fraudulent, or Prohibited activities.
8.1.2 We may, at our sole discretion, refuse or cancel Transaction Requests, Payment Requests, or Transactions to or from specific Senders or Payees, including entities and individuals listed on restricted or prohibited lists issued periodically by government authorities, as required by law, or if processing the Transaction Requests would potentially violate anti-money laundering or counter-terrorism financing laws and regulations. We may also decline to process a Transaction funded from certain Payment Instruments if we suspect their security has been compromised or if unauthorized or fraudulent use is suspected.
8.1.3 We may, at our sole discretion, refuse or cancel Transaction Requests or Transactions if Kori Money Transfer believes you are using the Service to make purchases from third parties you do not know or trust.
8.1.4 We may, at our sole discretion, refuse or cancel Transaction Requests, Payment Requests, or Transactions if:
a. Kori Money Transfer cannot verify your identity;
b. Kori Money Transfer cannot verify the identity of the Recipient;
c. You fail to provide information requested by us as per our obligations under relevant laws, pertaining to the purpose of a Transaction, as well as your identity and that of the Recipient.
d. Kori Money Transfer reasonably believes you are using the Service in violation of these Terms and Conditions or any applicable laws, rules, or regulations.
8.2 If Kori Money Transfer refuses or cancels a Transaction Request, Transaction, or Payment Request, we may, at our discretion, temporarily or permanently suspend your Registration.
8.3 If Kori Money Transfer temporarily or permanently suspends your Registration, or refuses or cancels a Transaction Request, Payment Request, or Transaction in accordance with this clause 8, we reserve the right to retain any Service Fees already incurred.
9. Our Customers Right To Cancel Refunds:
9.1 To the extent permitted by law, the customer understands and agrees that the request for Services is irrevocable, and Kori Money Transfer shall not be obligated to accept a stop-payment order after receiving an executed Payment request from the customer.
9.2 Despite clause 9.1 above, Kori Money Transfer may, at its absolute discretion, attempt to cancel your Instruction if you have informed us that you wish to revoke it. However, in some cases, Kori Money Transfer may have initiated an irreversible request for funds to be paid out to your Payee by a Service Provider, and therefore cannot guarantee successful cancellation. For successful revocations, Kori Money Transfer will typically refund your money, deducting any reasonable revocation charges and any Service Fees already charged, within five (5) Business Days.
9.3 If you encounter any issues using the Service, or if you are aware of any unauthorized or incorrectly executed Transactions, you should promptly contact us through the channels listed below, and in any event no later than 6 months after the Transaction Amount was debited, upon becoming aware of the unauthorized or incorrectly executed Transaction. A refund request must be submitted in writing (including via email) to one of the contact points listed at the bottom of these Terms and Conditions, providing the Sender's full name, address, and phone number, along with the Transaction tracking number, Transaction Amount, and the reason for your refund request:

9.4 If we have executed the Transaction according to the instructions you provided to us, and it turns out that the information was incorrect, we are not liable for the incorrect execution of the Transaction. However, we will make best efforts to recover the funds and may charge you a reasonable fee reflecting our efforts to do so.
9.5 If Kori Money Transfer has executed the Transaction differently from your Instruction, upon written communication from the Customer informing Kori Money Transfer of the discrepancy, Kori Money Transfer will refund the full amount debited. Except for exceptional circumstances, no adjustment will be made for any currency fluctuations that may have occurred between the time you pay us the Transaction Amount and the time of credit.
9.6 Any refunds will be credited back to the same Payment Instrument used to fund the Transaction and in the same currency.
10. Confidential And Proprietary Information:
10.1 Identification Program: In accordance with applicable Canadian federal and provincial laws, financial institutions are required to aid in combating money laundering and terrorism financing by collecting, verifying, and recording identifying information about all customers. Consequently, we may request personal identifying information from you and the Recipient, and we may also legally consult other sources to obtain information about both parties.
10.2 Verification and Checks: We will verify your personal details to confirm your identity, and we may need to do the same for the Recipient. All information provided by you will be treated securely and strictly in accordance with applicable law. By accepting these Terms and Conditions, you authorize us to make necessary inquiries to validate the information you provide. This may involve direct methods, such as requesting additional information from you or requiring steps to confirm ownership of your Payment Instruments or email address, as well as indirect methods, such as verifying your information against third-party databases or other sources.
10.3 Confidentiality: Kori Money Transfer acknowledges that information obtained from customers in connection with the Service may be confidential. We will endeavor to maintain the confidentiality of such information in accordance with the Terms and Conditions of this Agreement, our Policies and Procedures for safeguarding customer information, and applicable Canadian laws and regulations. However, Kori Money Transfer may disclose confidential information provided by the customer if necessary to complete the transaction or to comply with any applicable law. The customer acknowledges that Kori Money Transfer is not obligated to notify the customer either before or after disclosing confidential information. The customer agrees not to use Kori Money Transfer's confidential/proprietary information for any purpose other than using the Service. 11. Copyright Information:
Restrictions on Use:
We offer limited access and allow personal usage of this site, but explicitly prohibit downloading or modification (except for page caching) without our explicit written approval, with restrictions on any resale or commercial exploitation, including the collection of product listings, descriptions, or prices, derivative use of the site or its contents, and the use of data mining or similar tools without permission.
Intellectual Property:
Kori Money Transfer asserts ownership of the Content on the Site and the Services, comprising various forms such as information, software, text, design, images, video, and audio, safeguarded by a spectrum of intellectual property laws including copyright, trademark, patent, and trade secrets, prohibiting users from reproducing, distributing, modifying, publicly displaying, or transmitting said Content without authorization.
Trademarks:
The trademarks, trade names, and intellectual property associated with Kori Money Transfer, its affiliates, and suppliers, displayed on this site, are protected in Canada and internationally. Displaying them on this site does not grant any license or rights. Unauthorized use of these trademarks or intellectual property, whether in whole or in part, is strictly prohibited without prior written authorization from Kori Money Transfer or the relevant third party.
12. Warranty and Limitations on Liability:
12.1 If we have significantly violated these Terms and Conditions, resulting in a loss for the Sender, we will reimburse the Sender for the Transaction Amount and the Service Fee.
12.2 If a Transaction is delayed, fails, or is unauthorized, you may have the right to a refund or compensation under laws governing international money transfer services. Failure to promptly notify us of unauthorized or incorrectly executed Transactions within six months after the debit date may prejudice your right to such refund or compensation. Further details on your rights will be provided upon contacting us.
12.3 Any compensation claim must be supported by relevant documentation.
12.4 To the fullest extent permitted by applicable law, our liability for any loss not covered by rights under clause 12.2 is limited to the greater of the Service Fee or CAD 300, unless otherwise agreed in writing. This limitation applies per Transaction or series of related Transactions, or any single act, omission, or event. For instance, if you incur loss due to our failure under two unrelated Transactions, you might be eligible to claim up to CAD 500.
12.5 We do not accept responsibility for:
12.5.1 Service failures due to abnormal or unforeseen circumstances, obligations under applicable laws, rules, or regulations;
12.5.2 Communication facility malfunctions beyond our control affecting message accuracy or timeliness;
12.5.3 Losses or delays in message transmission due to internet or telecommunications service providers or software not under our control;
12.5.4 Website errors or Service issues caused by incomplete or incorrect information provided by you or a third party.
12.6 The services are provided "as is" and "as available," without any warranties, to the fullest extent permitted by applicable law. We expressly disclaim all other warranties, whether express, implied, or statutory.
12.7 This clause does not limit liability for death or personal injury resulting from negligence or fraud.
12.8 You are liable for losses from unauthorized Transactions or misuse of the Service due to your fraudulent or negligent actions. You agree to hold us harmless from any loss, damage, or claims arising from your use of the website or Service, violation of these Terms and Conditions, or infringement of another party's rights.
13. Governing Law and Jurisdiction:
This Agreement is governed by Ontario, Canada laws, and both parties agree to the jurisdiction of Ontario courts.
14. Change in Terms and Conditions:
We may modify the Terms and Conditions of this Agreement, with the effective date being the date of change unless stated otherwise.
15. Assignment:
The customer cannot assign this Agreement or its rights or obligations without our prior written consent. We reserve the right to assign our rights under this Agreement.
16. Waiver:
We may waive enforcement of any Terms and Conditions, but such waiver does not affect our rights regarding any other transaction or modify the Terms and Conditions or Service.
17. Electonic Communications:
17.1 You acknowledge that these Terms and Conditions will be agreed to electronically, and that the following types of information ("Communications") may be provided electronically:
17.1.1 These Terms and Conditions and any amendments, modifications, or supplements to them;
17.1.2 Your transaction records through the Service;
17.1.3 Any initial, periodic, or other disclosures or notices provided in connection with the Service, including those required by law;
17.1.4 Any customer service communications, including those regarding claims of error or unauthorized use of the Service; and
17.1.5 Any other communication related to the Service or Kori Money Transfer.
17.2 The Service does not allow for Communications to be provided in paper format or through other non-electronic means. You may withdraw your consent to receive Communications electronically, but doing so will result in the termination of your use of the Service. To withdraw your consent, you must contact us using the contact information provided at the end of these Terms and Conditions.
17.3 To access and retain Communications, you must have or have access to the following:
17.3.1 An internet browser that supports 256-bit encryption, such as Internet Explorer version 8.0 or above;
17.3.2 An email account, email software capable of interfacing with Kori Money Transfer’s email servers, and the capability to read email from Kori Money Transfer, along with a device and internet connection capable of supporting these functions; and
17.3.3 Sufficient electronic storage capacity on your device’s hard drive or other data storage unit; or
17.3.4 A printer capable of printing from your browser and email software.
17.4 Additionally, you must promptly update us with any change in your email address by updating your profile at www.korimt.com.
18. Complaints:
18.1 Should you desire to submit a complaint regarding any facet of the Kori Money Transfer service, kindly address your written complaint to the indicated address displayed on www.korimt.com.
